They aren't but SO bad anyways.  Hell, you can nab a copy of Super Metroid for 30 CENT right now if you own a Wii U.

I don't see how Nintendo exercising their right to enforce their copyright makes them an asshat. It's not like they're taking these videos. They're only making it so that those LPers who are monetizing this cannot be paid anymore on IPs they own without permission from them or partnering with a company/group who got their permission.

If you're making an LP video just for fun without any intent to profit, this shouldn't affect you.

Ha, I know what you mean.  I have IE installed which I only use for compatability issues with certain things.  I went to youtube while on it recently and was so puzzled by ads.

Capcom give out millions of content IDs all the time. I've had it done to me with piles of my videos for resi games.
Nintendo can do what they like anyway. They're their games and all that.

I've got mixed feelings on this. I had been considering the possibility of putting ads in my videos someday down the road if I ever somehow got a large enough following to make it remotely worthwhile. But that has never been my reason for making LPs so as long as Nintendo still allows the videos to be uploaded to YouTube, I will continue to do so. It does suck for guys like Chuggaaconroy who go above and beyond the standard to provide as much information on the games he plays, I feel like he, and guys like him, have earned a little something for that kind of quality material. But under current copyright laws, Nintendo can pretty much do what they want.

They are completely in their rights to do this, but there will be consequences. If memory serves Sega did this and no-one made new videos of Sega games. When Sega realised they were disappearing from YouTube they reversed their decision.

TotalBiscuit no longer covers Sega games I believe, or now Nintendo games - he's got a video discussing this here.

TB made a tweet a lil while ago saying he'll be taking down all his nintendo videos in protest. So he took down no videos. And while i stand by my statement of Nintendo are asshats, they are being no where near as bad as Sega were when they did this. Sega got channels completely shut down. And even after they back peddled those channels are still shut down.

For the record I am also an LPer, and I do think Nintendo getting 100% of the profits from these is wrong.  On one hand people watch LPs because of the games, but they do also watch for the specific narrative created by the player's actual play-through and also for their commentary.  Nintendo could have filed themselves in as a network and then structured their partnerships such that they could have split the revenue with the LPers who were promoting their games.

Treating an LP as if it's the same as uploading a movie isn't right.  If I recorded myself playing hockey with friends the company that manufactured our gear shouldn't have the right to 100% of the revenues, because people coming to watch the videos aren't there to just watch the equipment - it requires the players to become an entertainment product, and it requires the unique narrative generated by the playing of the game.  While Let's Play videos are perhaps more dependent on the company's product (more like a movie), they still shouldn't be treated as if the contents of an LP are 100% the property of the corporation.

It may not be right for a person to get 100% of the money off of ads while they LP a Nintendo game, but Nintendo shouldn't get 100% of it either - even if it is just a gameplay movie (because people are probably watching the video to observe the skill of a specific player), especially when there are mechanisms for them to split it fairly with the content creator.  And for the record, I know I have generated sales for games with my videos, so it's not like they were missing out on cash already.

Also: on the subject of content IDs, a lot of the time a video will get IDed based on it's music alone, and then a collection agency acting on behalf of the recording industry will collect 100% of the revenue.  That isn't right either.  They deserve some of it, but not all of it.

Coming from the developers side I don't mind seeing these videos on youtube (though their popularity is perplexing to me...must be particular to newer generations of gamers) I do think that 'anyone' (including Nintendo) that earns any revenue from these videos is crossing a line here. It's okay that it'd be free for anyone interested (like an academic paper), but to actually monetize from this...is ridiculous.

Before if you wanted to broadcast sutff like this there were a number of licenses and negotiations involved, so that all implied parties are satisfied and nobody would go to court (and of course there was revenue in T.V. Comercials, DVD sales, etc.) Everyone was paid off beforehand for the cost of production. So I think it's fair to say, everyone doing LP videos should have seen this coming, they themselves were monetizing in a gray, not exactly legit way. Now Nintendo is taking all the money as compensation for unforeseen Copyright violations (i.e making money off of a 'pirated product') and I think it's cool that they do that instead of shutting all LP'ers down.

Right, because a Let's Play contains no product other than the video game.  No one watches a specific gamer because of their skills at a given game, and no one cares at all about what a Let's Player says, ever.  They are only there to watch to game.  Just like sports.  There is no difference watching a bunch of 9 year olds play basketball versus watching the OKC Thunder play - the player makes no difference to the quality of entertainment of the game, and they are most definitely not the determining factor as to why it is entertaining at all.

And before we get off on the idea that gamer is in no way providing a service for the company, let us remember that these companies actually pay to have their game footage shown on youtube in the form of advertising (and usually in a shitty commercial-length format, not the comprehensive displays that LPs provide).  Honestly, an LP is the most authentic advertisement a video game can get.
