Gamestop makes new copies of XC, sells them Used for huge $.

If the government made it legal for parents to do whatever they want to kids (ie abuse them), who is to blame more, the government or the parents?  Government.

Similarly, while its not right for Gamestop to do whatever they want, Nintendo has the FIRST responsbility to stop it by printing more copies.  I'm not saying Gamestop isn't in the wrong, I'm saying Nintendo is more to blame.

The metaphor doesn't apply very well to things that aren't sentient. And if I was property, you'd be exactly right, not sarcastic,  with some small exceptions. If children, women, certain races, or any number of things were still chattle that would be a proper conclusion.  It's an IP, the rules are different than those regarding sentient beings, especially humans. It's been sold on some contractual terms to which none of us are privy to and those who create an IP are granted license to do anything they want to with. That is exactly true. They can even transfer their property rights in any number of varying ways. And then they can sell their property for any price they want. At which point a consumer can decide to buy or not buy the property or certain rights to the property, such as the right to own a single playable copy but not to reproduce it.

And I would blame both, since both have an obligation to do better than the absolute lowest they can acceptably get away with... which leads me to gamestop...

I 100% agree with your statement, I just don't agree with the idea that therefore we should not expect anything more or better, ever.  Companies can get away with providing the worst possible service or product that the consumer is willing to accept, but sometimes doing something really well can turn out really well for a corporation.  I would argue that it is in a company's interest to attempt to do things *well*, rather than wring every penny they can out of each consumer while offering as little as possible.  But hey - there's more than one way to skin that cat.  Gamestop is a bit more  a succubus, so I guess I'm not surprised.

I wouldn't argue against that point at all, but I would stick to my premise that in this case, Gamestop is barely commiting a sin, if at all. They didn't have to have any more of the game printed at all. So long as they were within their contractual rights, we're all better off. As evidenced by the fact prices are dropping. I also definitely agree with the argument that if anyone should be demonized in this situation it's Nintendo. if you demonize Gamestop for getting the copies at all int he first place or now, or for making the move that lowered the prices, I'd hate to know what we should think of every single seller on eBay who asked or accepted such supposedly outrageous prices.
